order with a formal letter requesting that the property owner correct the violations or make
contact with staff regarding this matter. Each of these notices listed violations of Chapter
607 of the City Code regarding exterior storage and parking of commercial vehicles in a
residential zone, junk and debris located around the home and garage as well as a large
quantity of old wood not stacked or placed according to the city ordinance. Mr. Peterson
has failed to bring the violations into compliance at this time and has failed to communicate
with staff any plausible resolution to the violations listed.
Section 607.09 Subdivision 5 provides the opportunity to reach compliance by abating
items in violation of the requirements contained within Chapter 607. In cases where no
immediate threat to the public health and safety exists the requirements of the City code
require that staff notify the property owner of their intent to seek City Council authorization
to abate the conditions present and their opportunity to be heard before the council,
provided however, that at least 10 days' notice is provided, staff has satisfied these and
other applicable requirements of Chapter 607 of the City Code.
Staff is not requesting authority to abate the commercial vehicle as a Ramsey County court
citation will be issued to Mr. Peterson on that violation.
Mr. Peterson was mailed his Notice of Hearing November 13, 2013 and was properly
notified of the proceeding abatement actions. Mr. Peterson responded to the Notice of
Hearing requesting a continuance as he would be out of the country. Mr. Peterson was
advised that his concerns would be addressed by the council on the night of the hearing
and it would be beneficial for him to provide the staff with a return date to inform the council
when the best possible resolution date would be.
Recommendations:
Forthe reasons noted above, Staff recommends City Council approval of Resolution 8171,
a resolution authorizing the abatement of noted code violations present on the exterior
property of 7895 Eastwood Road, to be commenced no earlier than December 14, 2013.
Respectfully Submitted,
Craig Swalchick
Housing and Code Enforcement Inspector
