order with a formal letter requesting that the property owner correct the violations or make <br />contact with staff regarding this matter. Each of these notices listed violations of Chapter <br />607 of the City Code regarding exterior storage and parking of commercial vehicles in a <br />residential zone, junk and debris located around the home and garage as well as a large <br />quantity of old wood not stacked or placed according to the city ordinance. Mr. Peterson <br />has failed to bring the violations into compliance at this time and has failed to communicate <br />with staff any plausible resolution to the violations listed. <br />Section 607.09 Subdivision 5 provides the opportunity to reach compliance by abating <br />items in violation of the requirements contained within Chapter 607. In cases where no <br />immediate threat to the public health and safety exists the requirements of the City code <br />require that staff notify the property owner of their intent to seek City Council authorization <br />to abate the conditions present and their opportunity to be heard before the council, <br />provided however, that at least 10 days' notice is provided, staff has satisfied these and <br />other applicable requirements of Chapter 607 of the City Code. <br />Staff is not requesting authority to abate the commercial vehicle as a Ramsey County court <br />citation will be issued to Mr. Peterson on that violation. <br />Mr. Peterson was mailed his Notice of Hearing November 13, 2013 and was properly <br />notified of the proceeding abatement actions. Mr. Peterson responded to the Notice of <br />Hearing requesting a continuance as he would be out of the country. Mr. Peterson was <br />advised that his concerns would be addressed by the council on the night of the hearing <br />and it would be beneficial for him to provide the staff with a return date to inform the council <br />when the best possible resolution date would be. <br />Recommendations: <br />Forthe reasons noted above, Staff recommends City Council approval of Resolution 8171, <br />a resolution authorizing the abatement of noted code violations present on the exterior <br />property of 7895 Eastwood Road, to be commenced no earlier than December 14, 2013. <br />Respectfully Submitted, <br />Craig Swalchick <br />Housing and Code Enforcement Inspector <br />
