Movlvns VIEW <br />of Mounds View Staff <br />Item No: 6B <br />Meeting Date: June 1, 2016 <br />Type of Business: Other Planning Activity <br />To: Mounds View Planning Commission <br />From: Jon Sevald, Planner <br />Date: June 1, 2016 <br />Item Title/Subject: Discussion; Accessory Dwelling Units <br />Introduction <br />During the May City Council Work Session, a resident requested that the City consider <br />allowing an apartment above an attached garage within the R-1 Single Family <br />Residential District. The Council directed Staff to investigate further. Staff presented a <br />report at the May 23`d Council meeting for discussion, and the Council directed the <br />Planning Commission to consider this topic. <br />Discussion <br />Specific to the question asked, it is Staff's interpretation of the City Code' that an <br />apartment above a garage which is to be occupied by a person or family unrelated to <br />the home's occupants, is a "Second -Family Dwelling", which is not permitted in the R-1 <br />Single -Family Residential District. The City Code does allow up to two boarders in a <br />single-family home, if there is a common entrance, and the kitchen and living areas are <br />accessible by all occupants. In this example, the home continues to function as a <br />Single -Family Dwelling. <br />Accessory apartments are commonly referred to as an "Accessory Dwelling Unit" <br />(ADU). Staff surveyed 18 area cities if they allow ADU's, and if so, how they are <br />regulated. Of the ten cities who responded, four allow something similar to an ADU, <br />summarized below: <br />Hugo: Permits ADU's in a detached garage for occupation by a family <br />member, caretaker, or employee (or similar). The ADU cannot be <br />rented as a second dwelling unit. <br />New Brighton: Permits "Separate living quarters for domestic servants employed on <br />the premises provided that the premises contains a minimum area <br />equal to two ordinary minimum sized lots in this district" , (i.e. the lot <br />must be at least twice the size of the minimum lot size). <br />1 City Code, Section 1102.02, Subd 43; Dwelling, Two -Family Unit, and Subd 44; Dwelling Unit <br />
