ORDINANCE NO. 09.10-12 <br />AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF EL <br />MIRAGE, ARIZONA, AMENDING THE CODE OF THE CITY OF EL MIRAGE, <br />CHAPTER 154, ZONING CODE, BY ADDING A NEW SECTION 154.090 <br />REGULATING THE LOCATION, PLACEMENT AND USE OF CARGO <br />CONTAINERS IN THE CITY, <br />WHEREAS, the use of cargo containers for accessory buildings, sheds, storage, <br />and other purposes has increased within the City causing in some instances a blight; <br />and, <br />WHEREAS, cargo containers present unique challenges to public safety, health <br />and welfare based upon their potential un -viewable contents and the lack of standards <br />for usage as accessory buildings; and, <br />WHEREAS, cargo containers, due to their size and Industrial appearance, are <br />not appropriate for use as permanent accessory buildings or storage sheds in all areas <br />of the City. <br />NOW, THEREFORE, it is hereby ordained by the Mayor and Council of the City <br />of EI Mirage that the Code of the City of EI Mirage, Chapter 154, Zoning Code, shall <br />hereby be amended to add a new § 154.090 fitted "Cargo Containers," which shall read <br />as follows: <br />154.090 CARGO CONTAINERS <br />154.090.1 Definitions <br />As used in this § 154.090, the following definitions shall apply unless the context <br />clearly indicates or requires a different meaning; <br />CARGO CONTAINER: Means an article of transport equipment which falls into any <br />of the following categories: <br />(a) Designed or constructed for or used to facilitate the packing, shipping, <br />movement, or transportation of freight, articles, goods or commodities by one <br />or more modes of transport; and/or <br />(b) Designed to be or capable of being (1) mounted or moved on a rail car, or Cil) <br />mounted on a chassis or bogie for movement by a tractor trailer, or (iii) <br />loaded on to a ship; and/or <br />(c) A prefabricated metal structure designed for use as an individual shipping <br />container in accordance with international standards or a metal structure <br />designed and built for use as an enclosed truck trailer in accordance with <br />U.S. Department of Transportation standards. <br />PERMANENT: Means a period of time limit that exceeds four (4) months on site <br />without being utilized for transportation purposes. <br />
