necessary to protect the public health, and on order of the city. Owners <br />may apply to the health authority for exemption from the requirement that <br />garbage and rubbish be disposed of at least once each week Such <br />application shall be on forms provided by the City and the applicant shall <br />provide all information reasonably required by the health authority The <br />health authority may grant such exemption imposing such conditions as the <br />health authority deems necessary, only- upon the determination that <br />approving the exemption will not be detrimental to the public health, safety, <br />welfare .or comfort. Such exemption may be revoked by the health authority <br />at any time. All garbage and rubbish s^all be disposed of in a sanitary <br />manner as approved by the health authority and shall not constitute a <br />nuisance. No person shall accumulate or hermit to accumulate any garbage <br />or rubbish on any property in the city which might constitute a fire hazard <br />or a nuisance by reason of appearance, odo--, sanitation, possible littering of <br />neighboring properties, or littering of the property on which the garbage or <br />rubbish is accumulated. <br />Section 3. The New Brighton Code is amended by adding new Section 11-11 as <br />follows: <br />Sec. 11-11. Unauthorized collection. <br />No person, firm, or entity other --han a licensed recycling hauler <br />operating under contract with the City or with the owner shall collect, <br />remove or dispose of recyclable material after they are set out for <br />collection. <br />Section 4. It is unlawful <br />for any person to collect and haul garb-ke, refuse, recyclables, or yard <br />waste without the appropriate license issued by the City under this section, <br />unless the person is collecting and haulinR7 from his or her own residence or <br />commercial establishment. Licenses shall be applied for, issued and <br />renewed as provided in this Chapter. Each licensee shall comply with all <br />applicable requirements of this chapter and failure to comply is ground for <br />suspension or revocation of the license. <br />Section 5. Code Section 11-31 is amended as follows: <br />Sec. 11-31. Application. <br />Any person desiring a license to collect garbage or rubbish shall make <br />application for the same to the city clerk upon a form prescribed by the city <br />council.
