He <br />stated that staff would present a revised ordinance for the Second Reading. <br />Ericson stated that the City has received an application from Calvin Academy to operate a <br />private education facility within Silver View Plaza, located at 2540 Highway 10. He stated that <br />while the intent of the Zoning District does present that this type of use would be permitted, the <br />Code does not specifically allow for it. He stated that, in an effort to eliminate any questions <br />regarding this type of use, staff proposes that it be added to the list of permitted uses, adding that <br />if no action is taken, Calvin Academy would operate and function by virtue of an administrative <br />Code interpretation. <br />Mayor Coughlin closed the Public Hearing at 7:34 p.m. <br />Council Member Marty asked if the applicant, as an educational facility, would be tax-exempt. <br />Ericson stated that this was a lease operation, noting that the owners of Silver View Plaza would <br />pay taxes, regardless of who leased from them. <br />Council Member Stigney stated that, in light of the effort to clean up the Code, the present <br />language may be limiting. He suggested the phrase "private educational or instructional <br />facilities." Ericson agreed that this was the intent of the amendment, and they could utilize this <br />wording to make it more explicit. <br />Council Member Quick asked if this would prohibit the Mounds View Public School District <br />from leasing a space in the district, and utilizing it for instructional purposes. Ericson stated that <br />it would not. Mayor Coughlin suggested the omission of the word "private," and to simply <br />indicate "educational or instructional facilities." <br />City Attorney Long stated that this broader definition of the use would be preferable, so as to <br />prevent a question of interpretation in the future. <br />Mayor Coughlin stated that it was the consensus of the Council to amend the language of the <br />ordinance to indicate "educational or instructional facilities." <br />MOTION/SECOND: Stigney/Marty.
