City of Mounds View Staff <br />To: Honorable Mayor and members of the City Council <br />From: Bruce A. Kessel, Finance Director <br />Item Title/Subject: YMCA agreement <br />Date of Report: June 24, 1999 <br />Attached is the revised YMCA agreement. The were various minor changes based upon the <br />review by the City Attorney and the Council comments. The following is a summary of some of <br />the changes: <br />Article IV, A, item 8 — added Park & Rec Commission review of equipment <br />Article VII, C — changed the August 31, 2000 date to December 31, 2000 because of the time it <br />took to get the agreement approved. <br />Article VIII — added items T & U. <br />Article IX — numerous minor changes. <br />Signature for YMCA changed to the YMCA's president and CEO. <br />Exhibit III, item 7 — added the right for the City to place additional restricts on use of City <br />vehicles if the City feels any additional restrictions are warranted at some time in the future. <br />At the time of this writing, I have not heard from the YMCA regarding their attorney's review of <br />the document nor on the above changes, however, the YMCA representative did not see any <br />major problem with the agreement. The State of Minnesota will also need to review the <br />document. In light of this, I would recommend that the Mayor and Clerk Treasurer be authorized <br />to finalize the agreement and execute it for and on behalf of the City. If there are any minor <br />changes that are needed, they would then be able to make such changes and sign it without <br />further City Council action. If, however, there are any major changes that are needed, they could <br />then bring it back for your review and approval. <br />
