Item No. <br />Staff Report No. <br />Meeting Date: June 21, 1999 <br />Type of Business: WK <br />WK: Work Session; PH: Public Hearing; <br />CA: ConsentAgenda; CB: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor & City Council <br />From: James Ericson, Planning Associate <br />Item Title/Subject: Discussion regarding a Conditional Use Permit request to allow <br />Merryville Farms to operate an outdoor produce stand at <br />Moundsview Square <br />Date of Report: June 16, 1999 <br />Background: <br />Merryville Farm Market is requesting a conditional use permit to operate their produce stand at <br />Moundsview Square from July 1, 1999 to September 30, 1999. The produce stand was granted a <br />CUP the last three years at this same location and staff is not aware of any problems associated <br />with this operation. No changes are being proposed from the previous years. <br />Because the applicant is an annual fixture at Moundsview Square, staff has drafted the resolution <br />similar to the Linder's CUP resolution, which does not have an expiration date and does not <br />require the applicant to reapply annually for the CUP, as long as certain conditions are met. The <br />conditions that will appear in the Merryville resolution are (among others): <br />"The applicant shall provide a letter ofpermission from property owner, a complete set ofsite plans and a <br />narrative description of the proposal on an annual basis to the Director of Community Development" <br />"This Conditional Use Permit may be reviewed by the Planning Commission and City Council if any <br />problems develop or if there are any changes to the operation deemed substantial enough to warrant such <br />review, in the estimation of the Director of Community Development or the City Council. " <br />The Planning Commission, at their meeting on June 16, 1999, recommended approval of this <br />CUP, the resolution for which is attached for your reference.
