Public <br />4 Works Director Peterson explained he was uncertain if the entire project could be completed in <br />5 30 days, but should be completed in less than 60 days. He reported staff would be working with <br />6 the contractor regarding the phasing of the project. <br />7 <br />8 MOTION/SECOND: Hull/Gunn. To Waive the Reading and Adopt Resolution 8952, Accept <br />9 Bid and Award Construction Contract to Northwest Asphalt for the Business Park North Street <br />10 Rehabilitation (Program Avenue, Quincy Street, Woodale Drive, Clifton Drive). <br />11 <br />12 Ayes — 5 Nays — 0 Motion carried. <br />13 <br />14 C. First Reading Ordinance 943, Updating Title 100 of the City Code. <br />15 <br />16 City Administrator Zikmund requested the Council introduce Ordinance 943 which would update <br />17 Title 100 of the City Code. He reported Kennedy & Graven was assisting him with this City <br />18 Code update. He reviewed a change in the language with the Council and recommended the <br />19 Ordinance be introduced. <br />20 <br />21 Brian Amundsen, 3048 Woodale Drive, encouraged the Council to delay action on this item. He <br />22 stated there were a number of matters that were connected to the Charter and he noted election <br />23 law was being reviewed by the Charter Commission. He believed it would be better to have <br />24 these matters resolved prior to updating Title 100. He expressed concern with the way staff and <br />25 the Council was deferring to State Statute and was wiping out the need for the City Charter. He <br />26 reported Mounds View was a unique community and he encouraged the Council to not allow <br />27 Mounds View to become homogenized by State Statute. <br />28 <br />29 Council Member Bergeron thanked Mr. Amundsen for voicing his concerns and discussed how <br />30 at times State Statute preempts City Code. He stated he believed it was very important for <br />31 Mounds View to remain a Charter City. <br />32 <br />33 Mayor Mueller thanked Mr. Amundsen for sharing his concerns with the Council. City <br />34 Administrator Zikmund commented further on the proposed changes within Title 100 and noted <br />35 these changes would be brought to the Charter Commission. He reported he was not proposing <br />36 to codify the changes at this time, but rather recommended this not be completed until later this <br />37 fall. <br />38 <br />39 Mayor Mueller suggested under Section 107.03 a statement be added to note Mounds View was a <br />4o home rule Charter City. City Administrator Zikmund reported he would discuss this suggestion <br />41 with the City Attorney. <br />42 <br />43 Mr. Amundsen stated he had concerns with the use of shall and may throughout the document. <br />44 Mayor Mueller encouraged Mr. Amundsen to speak with the City Administrator regarding these <br />45 concerns. <br />
