<br />Rezoning Report - 2408 County Road I <br />January 11, 2016 <br />Page 3 <br /> <br />Land Use: <br /> <br />According to the Zoning Code, the “purpose” of the existing B-1, Neighborhood Business <br />district is: <br /> <br />“to provide for the establishment of local centers for convenient, limited office, retail or <br />service outlets which deal directly with the customer for whom the goods or services are <br />furnished. These centers are to provide services and goods for the surrounding <br />neighborhoods and are not intended to draw customers from the entire community.” <br /> <br />The stated purpose of the B-2, Limited Business district is: <br /> <br />“to provide for low intensity, retail or service outlets which deal directly with the customer <br />for whom the goods or services are furnished. The uses allowed in this District are to <br />provide goods and services on a limited community market scale and located in areas <br />which are well served by collector or arterial street facilities at the edge of residential <br />districts.” <br /> <br />The uses that would be permitted in the B-2 district include those already permitted in the <br />B-1 District. W hile there is some overlap in the types of uses between the B-1 and B-2 <br />districts, those allowed in the B-2 district would tend to be busier or draw from a broader <br />area than the immediate neighborhood. The Council will need to consider whether these <br />uses would be appropriate at the subject property. <br /> <br /> <br />Planning Commission Review: <br /> <br />The Planning Commission reviewed this request at its meeting on December 2, 2015. <br />After reviewing the staff report and hearing from the property owner, the Commission <br />expressed an opinion that the request did not seem inconsistent with the Comprehensive <br />plan and would not be out of character considering the surrounding uses. After considering <br />the other criteria for amending the City’s official zoning map, the Commission directed staff <br />to prepare a resolution recommending approval of the requested rezoning of the property. <br />The Commission approved Resolution 1040-15 on December 16, 2015, which is attached <br />for the Council’s reference. <br /> <br /> <br />Public Hearing <br /> <br />The City Council held a public hearing on January 11, 2016, at which time a few residents <br />spoke regarding the request, expressing opposition to a liquor store and concerns about <br />littering from patrons of the convenience store. The Council acknowledged the residents’ <br />concerns and reminded community members that the proposed rezoning would allow for <br />uses other than a liquor store, some of which were read aloud for the public record. A <br />couple residents were not opposed to the rezoning, only to a liquor store. If the owner <br />does pursue a liquor store a subsequent public hearing would be required.
