<br />Item No: 07F <br />Meeting Date: April 11, 2016 <br />Type of Business: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Resolution 8551, Approving a One-Year Moratorium on the <br />Issuance of Any New Off-Sale Intoxicating Liquor Licenses <br />in the City of Mounds View <br /> <br />Introduction: <br /> <br />At the April 4, 2016, Work Session, the City Council discussed concerns about the City <br />Code and how Liquor Licenses are approved within the context of the business licensing <br />title as well as the Zoning Code. Due to these concerns, the Council requested guidance <br />from the City Attorney on how it could consider potential modifications to the Code while at <br />the same time deferring action on any requested licenses. <br /> <br />Discussion: <br /> <br />As reported at the Work Session, State law does not limit the number of off-sale liquor <br />licenses that the City of Mounds View may issue, however state law DOES limit the <br />number of ON-sale licenses to no more than twelve for a city of our population. There are <br />presently four off-sale licensed establishments in the City (three intoxicating and one 3.2% <br />license) and three on-sale licensed establishments. The City may restrict the number of <br />licenses it issues to a number less than that allowed by the State. <br /> <br />In addition to a City imposed limit on the number of licenses that can be issued, the City <br />may examine the zoning districts within which licensed establishments may operate. <br />Presently, an off-sale establishment may generally locate in areas zoned B-2, B-3 and B-4. <br />Presently, two of the City’s off-sale establishments are located in B-2 Districts and two in <br />the B-3 Districts. <br /> <br />Recommendation: <br /> <br />The City Attorney has prepared the attached Resolution 8551 which approves a one-year <br />moratorium on the issuance of any new intoxicating liquor licenses and directs that a study <br />be conducted in the interim to address questions raised by the Council. <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />City Administrator <br /> <br />
