<br /> <br /> <br />RESOLUTION 8551 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />A RESOLUTION CREATING A ONE-YEAR MORATORIUM ON THE ISSUANCE OF <br />NEW OFF-SALE INTOXICATING LIQUOR LICENSES WITHIN THE CITY OF <br />MOUNDS VIEW AND DIRECTING THAT A STUDY BE CONDUCTED <br /> <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOUNDS VIEW AS <br />FOLLOWS: <br /> <br />Section 1. Background. <br /> <br />1.01. Chapters 501-502 of the City Code establishes licensing regulations related to <br />intoxicating liquors (the “Licensing Regulations”). The purposes of the Licensing Regulations are to: <br />(1) provide minimum guidelines for the issuance of off-sale liquor licenses; (2) minimize adverse <br />effects of off-sale liquor establishments; (3) avoid potential over filtration of off-sale liquor <br />establishments; and (4) maximize the use of remaining potential off-sale liquor licenses. <br /> <br /> 1.02. The City Council has approved licenses for several different off-sale liquor establishments <br />in the past, and many of those licensees are still operating pursuant to their license. <br /> <br /> 1.03. The City Council has determined that before any additional new off-sale liquor licenses <br />are approved, that a study is necessary to examine the code and determine if any adjustments should be <br />made to the code. <br /> <br /> Section 2. Findings <br /> <br /> 2.01. The City Council finds that it is necessary to conduct a study to the off-sale liquor <br />regulations in the City Code and to make any adjustments that might be needed. The purpose of the <br />study will include, but is not limited to: (1) determining the number of off-sale liquor establishments <br />that may locate in the City; (2) analyzing the relationship between off-sale liquor stores and criminal <br />activity; (3) determining if any additional official controls should be used to regulate the sale of <br />intoxicating liquor; (4) determining whether there should be a minimum distance separation <br />requirement between off-sale liquor stores, and (5) determining in which zoning district such licensed <br />business may operate. <br /> <br /> 2.02. The City Council finds that there is a need to adopt a moratorium on the issuance of any <br />new off-sale liquor licenses while the study referenced in Section 2.01 of this Resolution is being <br />conducted. <br /> <br /> Section 3. Off-Sale Liquor License Study; Moratorium <br /> <br /> 3.01. A study is authorized to be conducted by the City staff and the City Council in accordance <br />with Section 2. <br /> <br />
