3.3 Fire Department agrees to furnish the building inspection and site review services <br /> and necessary personnel as requested by the City to the said designated areas in the City, for the <br /> consideration set forth below, and agrees that its building inspection personnel will make every <br /> reasonable effort to respond to requests from the City for inspection services. <br /> 3.4 Fire Department agrees to the position description and performance of the duties <br /> as described on ATTACHMENT A of this document. <br /> ARTICLE IV. COMPENSATION <br /> 4.1 Payment for the services provided by the Fire Department to the City shall be as <br /> follows: <br /> (a) The City will pay Fire Department a maximum of$40,000 per year, $5000 of <br /> which is due by January 1 of each contract year. The remainder will be billed throughout the <br /> year as work is performed. <br /> (b) In no event will the annual cost to the City for such services exceed$40,000. <br /> (c) Payment for services shall be made upon the presentation of billing statements to <br /> the Municipality. The Municipality shall make payment to the Fire Department within thirty <br /> (30)days of its receipt of the billing statement or make reasonable arrangements for payment <br /> acceptable to the Fire Department. <br /> 4.2 The Fire Department agrees to submit to the City a copy of the Fire Department's <br /> annual fmancial report as prepared by its certified public accountant no later than June 30 of each <br /> year. <br /> ARTICLE V. DEPARTMENT ORGANIZATION <br /> 5.1 The Fire Department agrees to remain at all times a non-profit corporation under <br /> Minnesota Statutes 317.17. <br /> 5.2 The Fire Department shall at all times be in compliance with such equipment, <br /> personnel and training standards relating to building inspections as may be required by the laws <br /> of the State of Minnesota and the Federal Government. <br /> 5.3 The entire cost of operation to the Fire Department of salaries, compensation, <br /> repairs and upkeep shall be borne by said Fire Department and payment shall be made from the <br /> consideration herein stated and the City shall be in no way liable for any amount other than the <br /> payment of the amounts herein set forth or any amounts negotiated under Article IV. <br /> 5.4 It is further agreed that the Fire Department shall carry Public Liability Insurance <br /> and Workers' Compensation Insurance for its personnel and on any of its equipment and the <br /> n:\users\caris\build.con Mounds View Building Inspector Contract-Draft 1-1/6/99 <br />
