operators of such equipment, said insurance to provide a minimum of$500,000 primary and <br /> $1,000,000 excess coverage. All insurance policies purchased by the Fire Department shall <br /> include the City as an additional insured and shall contain a cancellation clause requiring thirty <br /> (30)days' written notice to be mailed to the City prior to such date of cancellation. A certificate <br /> of insurance shall be provided to the City indicating the types and amounts of insurance in force. <br /> ARTICLE VI. DUTIES OF PARTIES <br /> 6.1 The Fire Department shall have all reasonable and necessary cooperation and <br /> assistance from the Municipality, its officers, agents, and employees, so as to facilitate the <br /> performance of this Agreement. <br /> 6.2 The Municipality shall have all reasonable and necessary cooperation and <br /> assistance from the County, its officers, agents, and employees, so as to facilitate the <br /> performance of this Agreement. <br /> ARTICLE VII. INDEMNIFICATION <br /> 7.1 The Municipality and the Fire Department mutually agree to indemnify and hold <br /> harmless each other from any claims, losses, costs, expenses, or damages, injuries, or sickness <br /> resulting from the acts or omissions of the respective offices, agents, or employees, relating to <br /> the activities conducted by either party under this Agreement. <br /> ARTICLE VIII. ENFORCEMENT <br /> 8.1 If any claim,proceeding or action is brought by the City or the Fire Department to <br /> enforce the provisions of this Agreement,the prevailing party shall be entitle, in addition to costs <br /> of suit,to reasonable attorneys' fees incurred in connection with any such claim,proceeding or <br /> action and the same may be awarded by the court having jurisdiction of such claim,proceeding <br /> or action. <br /> ARTICLE IX. CHOICE OF LAW <br /> 9.1 The provisions of this Agreement shall be construed in accordance with the laws <br /> of the state of Minnesota. <br /> ARTICLE X.
