Letters were sent out to the other affected <br /> property owners to alert them to the meeting this evening and to gain additional comment. Staff <br /> has not received any responses from these letters. <br /> Staff asked the Police Department to check for any police reports being filed at this property or <br /> nearby properties to establish a basis for Council action. Staff received copies of police reports <br /> which seem to indicate a neighbor to neighbor dispute, nothing more. The Police Department has <br /> stated that this block of Knollwood Drive does not pose a problem in terms of activities <br /> warranting police action. There are no reports on file other than those between the two property <br /> owners that would substantiate the need for a streetlight at this location. <br /> There are alternatives available to Mr. Mullner to light his property to discourage vandalism. <br /> Motion-detecting lights or flood lights can be installed on the house and/or small yard lights could <br /> be installed to light only his property which would not violate the City's nuisance and zoning <br /> ordinances. <br /> Recommendation: <br /> Staff is recommending that the City Council deny the request for a streetlight at the requested <br /> location and authorize staff to instruct NSP to remove the light behind the home due to the <br /> following reasons: <br /> 1. There is no current streetlight petition on file regarding this request. <br /> 2. At least one of the affected property owners objects to this request. <br /> 3. There are no documented or substantiated issues of crime or public safety concern. <br /> 4. Police reports indicate the presence of a neighbor vs. neighbor dispute. <br /> 5. The existing light violates the City's nuisance and zoning codes. <br /> 6. The property owner can install a floodlight on his house or utilize other residential lighting <br /> to accomplish yard lighting. <br /> James Ericson, Planning Associate <br />
