This ordinance, upon adoption and publication in the newspaper, will rezone the <br /> property located at 2670 County Road Ito allow for an assisted living senior residential facility to <br /> be constructed on the site. At that same meeting, after the public hearing, the Council directed <br /> staff to draft a resolution to approve the use itself, as it requires a Conditional Use Permit. <br /> Attached to this report is Resolution 5345, a Resolution approving such use as requested by the <br /> applicant, MSP Real Estate. <br /> Discussion: <br /> The proposed use addresses a specialized and unique niche in the elderly and infirm care industry, <br /> the likes of which are not evident in this immediate area. The conditions of the use, according to <br /> Section 1109.04, Subdivision 2, are as follows: <br /> a. Side yards double the minimum requirements established for this District and are <br /> screened in compliance with Section 1103.08 of this Title. <br /> b. Minimum lot area shall be no less than one (1) acre, or as provided in Section <br /> 1104.02, subdivision 2b(3). (Ord. 590, 11-29-96) <br /> c, Only the rear yard shall be used for play or recreational area. Said area shall be <br /> fenced and controlled and screened in compliance with Section 1003.08 of this Title. <br /> d. The site shall be served by an arterial or collector street of sufficient capacity to <br /> accommodate traffic which will be generated. <br /> e. All signing and informational or visual communication devices shall be in compliance <br />
