RESOLUTION NO.5354 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION DENYING A WETLAND ALTERATION PERMIT FOR <br /> LOTS 17 AND 18,EDGEWOOD SQUARE,REQUESTED BY <br /> OAKWOOD LAND DEVELOPMENT; <br /> PLANNING CASE NO. 565-99 <br /> WHEREAS, Oakwood Land Development has requested approval of a wetland alteration <br /> permit to construct two single-family homes on properties zoned R-1, Single-Family Residential, legally <br /> described as follows: <br /> Lots 17 and 18,Block 1,Edgewood Square,Ramsey County,Minnesota <br /> WHEREAS, parts of Lots 17 and 18 lay within the wetland designated as GF-4 in the City's <br /> Local Water Management Plan; and, <br /> WHEREAS,The City reviews all development that occurs within wetlands and their buffers <br /> because of the important role that wetlands play in maintaining the ecosystem and the area hydrology, <br /> in that they are critical to the present and future health, safety and general welfare of the land, animals <br /> and people within the City; and, <br /> WHEREAS, Lots 17 and 18 are completely contained within a drainage and utility easement as <br /> dedicated to the City in perpetuity as part of the Edgewood Square plat filed with Ramsey County on <br /> June 17, 1983; and, <br /> WHEREAS, on August 23, 1999,the Mounds View City Council denied a request to vacate <br /> part of said drainage an utility easement based upon the findings that the lots served a significant public <br /> purpose for drainage, buffering and flood control; and, <br /> WHEREAS, without City approval of the requested easement vacation, private construction <br /> activity may not occur on the subject lots. <br /> NOW THEREFORE BE IT RESOLVED that the requested wetland alteration permit is hereby <br /> denied as no private alterations or construction activities are allowed to be performed within a publicly <br /> dedicated drainage and utility easement. <br /> Adopted this 13th day of September, 1999. <br /> Dan Coughlin, Mayor <br /> ATTEST: <br /> Charles S.
