RESOLUTION NO. 5381 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION AUTHORIZING THE EXECUTION OF A LIMITED USE <br /> AGREEMENT TO PERMIT THE INSTALLATION, USE AND MAINTENANCE OF A <br /> DRIVEWAY OVER AND ACROSS UNIMPROVED CITY RIGHT OF WAY <br /> WHEREAS, Spencer Mistelske, the"Applicant," has requested permission from the City <br /> of Mounds View to install, use and maintain a driveway over and across unimproved City right of <br /> way to service a parcel of land fronting unimproved Laport Drive, legally described as: <br /> Lots 2 and 3, Block 1, SMUDER ADDITION, <br /> Ramsey County, Minnesota <br /> WHEREAS, the Mounds View City Council has reviewed the following documents <br /> regarding this proposal: <br /> a. Wetland Delineation Report <br /> b. Wetland Zoning Map <br /> c. Plat Map <br /> d. Letter from Mr. Mistelske, dated 9/13/99 <br /> e. Purchase Agreement, dated 8/19/99 <br /> f Staff Report <br /> g. Site Survey <br /> h. Limited Use Agreement <br /> I. Staff Report <br /> WHEREAS, the Mounds View City Council finds that the installation of a driveway over <br /> and across City right of way would not be detrimental to the health, safety and public welfare of <br /> the community; and, <br />
