Inc Purchase and Redevelopment Agreement Revisions <br /> Dear Steve: <br /> I am writing in reference to the above-noted matter and with a suggested course of action to <br /> rectify some legal description and easement grant discrepancies. <br /> In order to resolve this matter, the following corrective measures should be taken as soon as <br /> possible: either amend the legal description to be conveyed (including a retained easement road <br /> right-of-way) or process a minor subdivision/lot split for the parceL In addition, a new document <br /> should be executed as to the utility easement which was previously attempted to be granted by <br /> the EDA to the City. Such utility easement must now be granted by Preferred Builders, Inc. to <br /> the City. <br /> Thus, in order to allow Preferred Builders, Inc. to quickly obtain a building permit for the <br /> Property. I recommend that the following amendments/acts be completed to resolve this matter: <br /> 1. Amendment of the Purchase and Redevelopment Agreement as to: <br /> a. the legal description revision for the Property: the West 218 feet of the entire 103 <br /> feet of Lot 34, rather than the North 53 feet of Lot 3d: and <br /> b. the required granting of the roadway and utility easement by Preferred Builders, <br /> Inc. as noted in Paragraph No. 2 below; and <br /> c. the required granting of the utility easement by Preferred Builders. Inc. as noted <br /> in Paragraph No. 3 below. <br /> 2.
