April 6. 1998 <br /> Page 2 <br /> following described property: <br /> The west 218 feet of the South 50 feet of the North 103 feet of Lot 34, <br /> Auditor's Subdivision No. 89, Ramsey County, Minnesota. <br /> The granting of the roadway casement by Preferred Builders, Inc. to the City will obviate <br /> the need to process a minor subdivision/lot split for Lot 34. Auditor's Subdivision No. <br /> 89, Ramsey County, Minnesota, thus, saving substantial time in resolving this matter. <br /> 3. The granting of utility easement by Preferred Builders, Inc. described as follows: <br /> A perpetual easement for utility purposes over, under and across the North 5 feet. <br /> the South 10 feet,the East l0 feet and the West 10 feet of the following described <br /> real property: <br /> The West 218 feet of the North 53 feet of Lot 34 and the South 27 <br /> feet of the West 218 feet of Lot 35, all in Auditor's Subdivision <br /> No. 89. Ramsey County, Minnesota. <br /> Since an amendment is required to the Purchase and Redevelopment Agreement, appropriate <br /> authorization from the Economic Development Authority for such amendment is necessary (a <br /> resolution needs to be prepared granting such authorization). If such authorization is granted at <br /> the ED A's next meeting.it appears that this matter could be resolved and all documents recorded <br /> very shortly thereafter. Per our conversations concerning this matter, I will begin to draft the <br /> above noted revisions to facilitate the quick completion of this matter. The President and <br /> Executive Director of the EDA would then have to execute the amendment to the Purchase and <br /> Redevelopment Agreement and the revised deed. <br /> Once the closing documents and the above-noted amended documents are recorded, a building <br /> permit could then be issued to Preferred Builders.
