Whiting, its City Clerk-Administrator <br /> Approved as to form and content: <br /> By: <br /> City Attorney <br /> Another item to be considered <br /> IMPLEMENTATION OF AGREEMENT <br /> The parties agree that any disagreement, dispute or claim that arises regarding the <br /> exercise of this Agreement shall be resolved as follows: <br /> 1. Any party may notify the other party, in writing, of the existence of a <br /> disagreement, dispute or claim, stating the nature of such disagreement, dispute or <br /> claim, with specificity; <br /> 2. On the date of receipt of such notice, the City and ETC shall each advise the other <br /> of the identify of the representative who will be available to meet as soon as <br /> reasonably possible (not later than 9:00 a.m. of the next business day) for the sole <br /> purpose of selecting a mutually acceptable third person to participate in the <br /> resolution of the disagreement, dispute, or claim. The party initiating the notice <br /> pursuant to this section, shall make arrangements for location for such meeting; <br /> 3. As soon as reasonably possible following the identification of such third party <br /> (not later than the next business day), a meeting involving the representatives <br /> from ETC and the City and the third party will take place. If there is a breakdown <br /> in the resolution process or(ii) either party refuses to accept the decision reference <br /> as above captioned, the sole remedy hereunder shall be termination of this <br /> Agreement pursuant to the termination selection. <br /> Page 8 <br />
