10. The City agrees to fund a building and equipment replacement fund. Funding shall be by <br /> annual appropriation. The City agrees that the minimum appropriation shall be $20,000 <br /> in 1999 and be raised annually by the CPI. The building and equipment funds shall be <br /> available for replacement of carpeting, HVAC systems, roof replacement, and other <br /> similar items. <br /> ARTICLE IV: TERMINATION <br /> If the YMCA fails to perform any of the terms,conditions, or requirements of this Agreement, <br /> the City will give the YMCA thirty days' written notice of such failure. After receipt of the <br /> written notice, the YMCA will have up to thirty days to correct the problem, except that the City <br /> may in any case take immediate steps at The YMCA's' expense to correct the problem in order <br /> to protect the health, safety and welfare of the City and the public prior to the end of the 30 day <br /> period without affecting the City's right to terminate the YMCA. If the YMCA fails to correct <br /> the problem within the thirty day period. the City may terminate the Agreement by giving The <br /> YMCA thirty day's written notice of such termination. <br /> If the City fails to perform any of the terms, conditions or requirements of this Agreement, the <br /> YMCA will give the City thirty days' written notice of such failure.
