Consideration of Resolution No.5230,Concerning Access to Anthony Properties <br /> 2 Management/O'Neil PUD at 2430 Highway 10. <br /> 3 <br /> 4 Mr.Rick Jopke,Community Development Director,provided a brief re-cap of this development proposal. <br /> 5 The applicant,Anthony Properties is proposing to construct a 63,000 square foot, 15 screen 2,188 seat <br /> 6 movie theater,three 11,000 square foot one-story office buildings,a 5,000 square foot restaurant and a <br /> 7 6,400 square foot retail/restaurant building on the site located at 2430 Highway 10. <br /> 8 <br /> 9 Mr.Jopke noted that there are three steps in the PUD process-a general concept plan,a development stage <br /> 10 plan and a final plan. On May 12, 1997 the City Council approved the General Concept Plan for this <br /> 11 development. The Development Stage Plan,which is before the Council now is the next step in the <br /> 12 process. This includes a more detailed plan of the development. The Planning Commission reviewed the <br /> 13 plan and recommended approval of the Development Stage Plans with a number of stipulations. The City <br /> 14 Council must conduct a Public Hearing and grant approval,resubmit the plan to the Planning Commission <br /> 15 for further consideration or deny approval of the plan. There is a 60 day requirement for Council approval <br /> 16 which is due to expire on May 17, 1998,and if the council does not approve the project,they must either <br /> 17 deny it or grant a 60-day extension. <br /> 18 <br /> 19 Mr.Jopke explained the review and evaluation criteria for development stage plans and provided a brief <br /> 20 summary of staffs fmdings regarding each. Essentially,all criteria has been met,with the exception of <br /> 21 the signalized intersection on Highway 10 which has not obtained approval from MnDOT. It was noted <br /> 22 that the signalized intersection as proposed with a right-in and right-out is important to the development of <br /> 23 the property and working with MnDOT in regard to this issue will be important. Mr.Jopke discussed the <br /> 24 changes which have been made since the general concept plan which was approved in 1997. <br /> 25 <br /> 26 The Planning Commission has reviewed the development stage review and is recommending Council <br /> 27 approval with stipulations. Mr.Jopke went through the stipulations of the resolutions. <br /> 28 <br /> 29 Mr. Wendell Smith of Anthony Properties provided a brief overview of the history of the project. He <br /> 30 provided copies of the plans which were approved by the Planning Commission and the City Council in <br /> 31 1997,and discussed how the plans have changed since that time. He noted that the revised plan has better <br /> 32 quality than the original plan. He provided renderings of the proposed theater and office buildings. He <br /> 33 noted that there are still no access points onto County Road H-2 or Long Lake Road. A diagram was <br /> 34 provided depicting the new proposed signalized intersection. He noted that it is very important from a <br /> 35 safety and traffic standpoint that this signalized intersection be approved and it was their understanding that <br /> 36 MnDOT had approved it. On April 22nd, however,they were notified that MnDOT will not agree to this <br /> 37 signalized intersection without access being provided to Long Lake Road or County Road H-2. <br /> 38 <br /> 39 Mr. Smith asked that the Council approve the development plan,the buffer permit and strongly endorse the <br /> 40 intersection as shown on the plan and work with MnDOT to obtain permission of the signalized <br /> 41 intersection before the commencement of construction. <br /> 42 <br /> 43 Mayor McCarty opened the Public Hearing at 9:55 p.m. <br /> 44 <br /> 45 Milly Ash,2664 Lake Court Drive, asked for a clarification on the access to the restaurant site from Long <br /> 46 Lake Road. Mr. Smith noted that the plan shows a entrance and exit to the restaurant site from Long Lake <br /> 47 Road,however MnDOT has indicated that they will not allow for a right-in/right-out to Highway 10 and <br />
