UNAPPROVED <br /> Page 5 <br /> April 27, 1998 <br /> Mounds View City Council <br /> 1 MOTION/SECOND: Quick/Stigney to approve the Introduction of Ordinance No. 615,an Ordinance <br /> 2 Vacating a Portion of a Drainage and Utility Easement over and across Lots 2 and 3,North Star Industrial <br /> 3 Park 2nd Addition,and to waive the reading. <br /> 4 <br /> 5 VOTE: <br /> 6 <br /> 7 Council member Stigney aye <br /> 8 Council member Koopmeiners aye <br /> 9 Council member Quick aye <br /> 10 Mayor McCarty aye <br /> 11 <br /> 12 Motion Carries(4-0). <br /> 13 <br /> 14 Mayor McCarty noted that the Second Reading of Ordinance No.615 will be held on May 11, 1998. <br /> 15 <br /> 16 D. 7:20 p.m.Public Hearing and Consideration of Resolution No.5219,a Resolution Approving a <br /> 17 Comprehensive Plan Amendment for Properties Located at 2625 Highway 10 and 7715-7761 <br /> 18 Eastwood Road,Changing the Land Use Designations from Low and High Density Residential to <br /> 19 Neighborhood Commercial,Requested by TOLD Development Company. <br /> 20 AND <br /> 21 <br /> 22 E. 7:20 p.m. Public Hearing and Introduction of Ordinance No.614 an Ordinance to Re-zone <br /> 23 Properties Located at 2625 Highway 10 and 7715-7761 Eastwood road from R-3,Medium Density <br /> 24 Residential and R-1,Single Family Residential,to B-2,Limited Business Districted,Requested by <br /> 25 TOLD Development Company. <br /> 26 <br /> 27 Mr.Ericson asked that Items D and E be considered together as they relate to the same project. <br /> 28 He explained that the Planning Commission voted to approve the Resolution to amend the Comprehensive <br /> 29 Plan and also to approve the rezoning of the property. The applicant has requested continuance of these <br /> 30 items for two weeks until the next regular Council meeting. <br /> 31 <br /> 32 Attorney Long explained that under the State Statutes, approval of a Comprehensive Plan amendment <br /> 33 requires a 2/3 vote of the council(in this case,four members of the council to approve). Under state <br /> 34 statutes regarding zoning amendments,approval requires a 4/5 vote(all four council members present). <br /> 35 <br /> 36 MOTION by Mayor McCarty to deny the request for a continuance. Notices have gone out to the public <br /> 37 and many residents have taken the time to come to the council meeting(noting the full council chambers). <br /> 38 <br /> 39 MOTION FAILS FOR LACK OF A SECOND. <br /> 40 <br /> 41 MOTION/SECOND: Quick/Stigney to grant the request for a continuance of Items 5(D)and(E). <br /> 42 <br /> 43 Attorney Long noted if the continuance is granted and the Public Hearing is continued,a date must be <br /> 44 specified in the motion so that the public is made aware. This will also alleviate the necessity to re- <br /> 45 publicize the public hearing notice. <br /> 46 <br />
