Page 5 <br /> May 26, 1998 <br /> Mounds View City Council <br /> MOTION/SECOND: Quick/Koopmeiners to approve Resolution No. 5240, a Determination of <br /> sufficiency of Petition Concerning the Anthony Properties Management Project. <br /> VOTE: Ayes - 4 Nays - 1(Stigney) Motion Carried <br /> MOTION/SECOND: Stigney that the City not grant any permits for the Anthony Properties <br /> Development until the issue of insufficiency is resolved with the petitioners. <br /> Mayor McCarty asked for The City Attorney's opinion on the motion. <br /> City Attorney Long told the Council if there was a sufficient petition before the City, there would <br /> then be a basis to consider delaying the permits; although, that would not be a clear cut answer. <br /> Lacking a sufficient petition, denying permits on a project that has received previous Council <br /> approval, could subject the City to litigation over the denial of the permits. <br /> Stigney asked for a clarification. He said he did not state to deny the permits but said to defer <br /> granting of building permits until the matter is resolved. <br /> City Attorney Long told the Council there would be no valid reason to defer the permits. <br /> Stigney restated his motion: "Defer granting of permits from the City to the developer for the <br /> properties indicated until the issue of the sufficiency of the resolution, or the sufficiency of the <br /> initiative is resolved, within a 30 day time period." <br /> Mayor McCarty stated for the Body: "Defer granting permits from the City to the <br /> developer(Anthony Properties) until the resolution,the initiative petition, determine the <br /> sufficiency of the petition is resolved, within 30 days." <br /> The motion failed due to a lack of a second. <br /> Barbara Haake stated her opinion in opposition to the Anthony Properties Development <br /> because of the ingress and egress to the development. She asked if there was a way to use the <br /> City's Attorney and the City's funds to force MnDOT to do what the City would like to see done; <br /> develop the property without the proposed cut-ins to H2 or Long Lake Road. Haake agreed that <br /> with the addition of the new community center a traffic light was needed at the intersection of <br /> Highway 10 and Edgewood. <br /> Mayor McCarty told Haake that it is MnDOT's opinion that the new community center, by itself, <br /> would not warrant a light at the intersection of Highway 10 and Edgewood. <br /> Greg Padgin, asked the Mayor how the City would respond to bumper to bumper traffic that is <br />
