4. Adopt an annual budget and a five year and ten year capital improvement plan for the <br /> Facility and Center on or before Dedember 31st for the subsequent year. In addition, it <br /> will work with Images to develop and implement the capital improvement plan for the <br /> subsequent year. <br /> 5. In 1999, the City shall budget and provide resources for the following services, not to <br /> exceed amounts listed below: <br /> a. Yellow Pages advertising $2,200 <br /> b. Postage $1,000 <br /> c. Printing costs $2,000 <br /> d. Other advertising $2,000 <br /> Any outlays in excess of these amounts are the responsibility of Images. In future years, <br /> the amount will be adjusted for inflation or by mutual agreement between the City and <br /> Images. <br /> 6. Provide Images with a list of dates the City wishes to use the facility as follows: <br /> a. On or before the first business day of January,provide a list of dates for the <br /> period from January 1 to June 30 of the subsequent year; and <br /> b. On or before the first business day of July, provide a list of dates for the period <br /> from July 1 to December 31 of the subsequent year. <br /> After these times, the City recognizes that its ability to use the Facility will be restricted <br /> to times when the Facility has not been reserved by other parties. <br /> 7. For a City use of the Facility, Images will not be required to provide any supervision for <br /> such event, unless: <br /> a. The event is considered gross revenues for purposes of calculating compensation <br /> in Article II and the City requests Images to provide the supervision included in a <br /> standard none City rental; or <br /> b. The City agrees to pay Images a fee for providing supervision or other services. <br /> 8. With input from Images, the City shall hire and pay the staff necessary for setting up and <br /> taking down tables, etc. for events at the Facility. As noted in Article III A 19, if <br /> adequate notice is not given, Images will be responsible for one-half the cost of staffing <br /> for the set up and take down for that event. <br /> 9. Provide custodial services and maintenance for the Facility, and agree to keep the Facility <br /> and related equipment in good repair. As noted in Article III A 19, if adequate notice is <br /> not given, Images will be responsible for one-half the cost of custodial service for that <br /> event <br /> 10. Upon receiving notice from Images or another party, the City will repair HVAC, <br /> plumbing, or other problems as soon as practicable in the manner that will cause the least <br /> disruption to current and future rentals. <br /> Page 6 <br />
