The owner will pay SAC and WAC charges. The <br /> contractor shall make arrangements for any required inspections, and pay any associated <br /> fees and shall obtain the Certificate of Occupancy for the project." <br /> 4. Add to paragraph 3.12.7: "The architect shall have a right to rely on the adequacy of the <br /> design when the contract documents require materials, equipment or systems to be <br /> designed by an engineer or licensed professional. <br /> D. Article 5 - Subcontractor <br /> 1. Add the following subparagraph 5.2.5: "Acceptance of any materials, supplier or <br /> subcontractor shall not imply acceptance of any material or product not specified in the <br /> contract documents." <br /> E. Article 7 -Changes in the Work <br /> 1. Add to paragraph 7.3.4: Costs related to a change shall be direct costs. All indirect costs <br /> shall be included in the contractor's overhead. Overhead (including general conditions) and <br /> profit related to a change shall be limited to 10% of the net cost of work by the contractor <br /> and 10% of the cost of work by subcontractors. Subcontractor mark-up is similarly limited. <br /> F. Article 9 - Payments and Completion <br /> 1. Revise subparagraph 9.6.2 by adding a new subparagraph 9.6.2.1 to read as follows: <br /> 9.6.2.1 Until Substantial Completion, the Owner will pay 95 percent of the amount due the <br /> III Contractor on account of progress payment. Upon Substantial Completion, the Owner may <br /> reduce retainage to 2 percent and pay 98 percent of the amount due the Contractor on <br /> account of progress payment until Final Payment. <br /> G. Article 11 - Contractor's Liability Insurance <br /> 1. Revise subparagraph 11.1.1 by adding a new subparagraph 11.1.1.8 to read as follows: <br /> 11.1.1.8 Liability insurance shall include all major divisions of coverage and be on a <br /> comprehensive basis including: <br /> 1. Premises Operations <br /> 2. Independent Contractor's Protective. <br /> 3. Products and Completed Operations. <br /> 4. Personal Injury Liability with Employment Exclusion deleted. <br /> 5. Contractual, including specified provision for Contractor's obligation under Paragraph <br /> 4.18. <br /> 6. Owned, non-owned and hire motor vehicles. <br /> 7. Broad Form Property Damage including Completed Operations. <br /> 8. Umbrella Excess Liability. <br /> 2. Add the following paragraph 11.1.4: "Contractor's Liability Insurance -The contractor will, <br /> during the life of the contract, purchase and maintain insurance coverages and limits as <br /> follows: <br /> 3. Revise subparagraph 11.1.2 by adding a new subparagraph as follows: 11.1.2.1 The <br /> insurance required by subparagraph 11.1.1 shall be written for not less than the following or <br /> greater if required by law: <br /> • 1. Worker's Compensation: <br /> a. State: Statutory <br /> b. Applicable Federal (e.g. Longshoremen's): Statutory <br /> c.
