The dedication amount would be$68,400 for this development. Mr.Ericson noted that the final plat has been reviewed by Ramsey County and approved except for one technicality which is expected to be resolved. Additionally, the City Engineer, Director of Public Works and the Rice Creek Watershed District have reviewed it and found it acceptable. Mr.Ericson noted a minor change to Resolution No.5212. The 9th and 10th WHEREAS clauses should be removed from the resolution. Stipulation 5.should be added to read 5. Approval of this plat shall be subject to a satisfactory title opinion by the Mounds View City Attorney. Public Hearing to Consider Licenses for 2400 Highway 120,doing business at Donatelles: 1. Public Hearing on transfer of on-sale liquor license. • 2. Consider transfer of liquor license from Donatelle's Inc.(Edward Donatelle)to 2400 Highway 10,Inc.(Jeffrey Weyek)-expires 6/30/98. 3. Consider issuance of an amusement center license and associated amusement devices licenses- expires 12/31/98. 4. Consider issuance of a restaurant license-expires 12/31/98. Mayor McCarty opened the Public Hearing at 7:29 p.m. Mr. Kessel,Finance Director,explained that there have been a number of comments made by residents with regard to this transfer. Concerns addressed include the location of the garbage containers,the incinerator on the property and the parking situation. Mr.Jopke noted that he is unable to fmd anything in the ordinance that would require that these concerns be addressed before the transfer can be made. However,the concerns will be addressed under the city code. Pat Michna,5287 Edgewood Drive,stated there have been many complaints of accidents in the area due to lack of driveway or entrances/exits from the street. She is also concerned about the garbage containers which she feels are inadequate for the type of business. Other concerns she addressed were the junk and debris at the rear of the property(she is not sure if this is part of the Donatelle property), whether or not there are sufficient parking spaces for the business,and the incinerator on the property. Attorney Reeds explained that these issues deal with code enforcement and that the transfer of the liquor license cannot be denied because of the concerns addressed. Mr.Jopke noted that the entrance/exits will be taken into consideration at time of street reconstruction iowhich is expected to take place within the next two to three years. In regard to adequate parking,Mr. Jopke stated he was unable to respond but would check on it to be sure it is in code compliance.
