• RESOLUTION NO. 5034 <br /> PAGE TWO OF FOUR <br /> WHEREAS,plans for S.A.P. 62-677-21 showing proposed alignment profiles, grades, <br /> and cross sections for the improvement of CSAH 77 within the limits of the City as a County <br /> State Aid Highway project will be presented to the City; and <br /> WHEREAS, the project includes, in addition to other things, grading, paving, concreted <br /> curb and gutter, storm sewer, turf establishment, and utility adjustments; and <br /> WHEREAS, the grading provisions require acquisition of certain right of way and <br /> temporary construction and slope easements prior to construction; and <br /> WHEREAS, the project will be submitted to the Minnesota Department of Transportation <br /> to determine the eligibility of the storm sewer for State Aid funds; <br /> NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br /> 1. The County shall prepare the necessary plans, specifications and proposals in <br /> accordance with the approved feasibility study. Costs of revisions to project items previously <br /> 0 approved in the feasibility study will be paid for by the party requesting the revisions. <br /> 2. The County shall take bids, and with concurrence of the City, award a contract for <br /> construction of this subject project; the County shall perform the construction inspection; the <br /> City shall assist the County in the inspection of City utilities. <br /> 3. The City shall acquire and pay for all easements and rights of way required for the <br /> construction of the project within the City. <br /> 4. All County road rights of way and temporary easements will be in the name of the <br /> County, and parking and other regulations will be controlled by the County. Any rights of way <br /> which cannot be negotiated will be acquired through eminent domain proceedings and thereafter <br /> assigned by the City of the County. Upon completion of the project,the County shall vacate <br /> right of way not needed for highway purposes to the City. <br /> 5. The County and City shall participate in the costs of construction in accordance <br /> with the attached Ramsey County Public Works cost participation policy dated 5/1/91 <br /> (Attachment B) except as modified below. <br /> 6. The County and City shall participate in the costs of storm sewer construction to <br /> the extent to be identified by the MN/DOT Hydraulics Engineer's Memorandum on storm sewer <br /> 0 cost participation percentages. <br />
