LLP, owns the Mounds View Square Shopping Center. They <br /> are anticipating an expansion of the shopping center to include 5,000 additional feet of retail space, and two <br /> dinner house style restaurants which would replace Bridgeman's and Hardee's. There are 477 parking spaces <br /> on the site. The expansion will result in 23 parking spaces being eliminated, leaving 454 parking spaces on <br /> site. The Planning Commission has approved a variance in the parking ratios which would be applied to the <br /> retail space and the dinner house restaurants such that 492 spaces are required for the shopping center with the <br /> expansion. <br /> . he applicant is requesting a conditional use permit for the joint use of parking facilities at the Mounds View <br /> Square Shopping Center as is provided in Section 1121.15 of the Zoning Code. This section allows parking <br /> requirements to be adjusted where there are two or more uses located on the same property which have <br /> offsetting parking demands, i.e. certain uses are primarily daytime uses and other uses are primarily nighttime <br /> or Sunday uses. Uses listed as primarily daytime uses are: <br /> • banks,business offices,retail stores,personal service shops,household equipment or furniture shops,clothing or <br /> shoe repair or service shops,manufacturing,wholesale and similar uses. <br /> Uses listed as primarily nighttime or Sunday uses include: <br /> • auditoriums incidental to a public or parochial school,churches,bowling alley,dance hall,theaters,bar or <br /> restaurant. <br /> Section 1121.15 allows 50% of the off-street parking facilities needed for nighttime and Sunday uses to be <br /> provided by the parking provided for daytime uses, and 50% of the off street parking facilities needed for <br /> daytime uses to be provided by the parking provided for nighttime and Sunday uses. Mounds View Square <br /> includes both types of uses. The reduction from 492 to 454 parking spaces represents an 8% allowance for <br /> joint parking. The criteria for granting this type of conditional use permit are stated in Section 1121.15 Subd. <br /> 1.b(6). These criteria appear in City Council Resolution No. 5041, along with findings as to how the criteria <br /> are met (see attached resolution). <br /> 111 <br /> RECOMMENDATION: The Planning Commission, on a vote of 7 ayes and 0 nays, and the staff recommend <br /> approval of this conditional use permit. A copy of Planning Commission Resolution No. 486-96 is attached. <br />
