Mayor and City Council <br /> Abatement at 5440 Jackson <br /> December 9, 1996 <br /> Page 2 <br /> On November 20, 1996, The City again sent a letter to Mr. Courtney because (1) he had not made contact <br /> • <br /> with the City in reference to his clean-up plans and (2) site inspections on November 12th and the 19th <br /> revealed that none of the requested actions had been completed. This letter stated that Mr. Courtney was to <br /> contact City staff no later that November 25, 1996 to discuss clean-up plans or the City would request a City <br /> Council hearing to authorize abatement of the property. Mr. Courtney did not make contact with City Staff by <br /> November 25, 1996 as requested, thus staff requested the City Council to set a hearing date of December 9, <br /> 1996, to authorize abatement of 5440 Jackson Drive. The City sent a letter to Mr. Courtney dated November <br /> 26, 1996, to inform him of the abatement hearing which had been set for December 9, 1996. <br /> In phone conversations and personal meetings, Mr. Courtney has expressed his willingness to correct the <br /> violations and has appeared cooperative; the violations, however, remain uncorrected. It should also be <br /> mentioned that while Mr. Courtney did remove some of the nuisance vehicles that were observed during an <br /> October 11, 1996 site inspection, two additional vehicles have been moved into the backyard in violation of <br /> the City's Nuisance Code: a large, white commercial delivery/moving van and a 1977 Cadillac which is not <br /> registered to Mr. Courtney. <br /> Authorization of abatement is necessary in order to correct a dangerous and unhealthy condition which has <br /> had a blighting influence upon the neighborhood and which affects the safety, well-being and comfort of the <br /> surrounding community. Abatement will ensure that all of the nuisances present at 5440 Jackson will be <br /> corrected or remedied. <br /> All correspondence with Mr. Courtney since October 1, 1996, has been included for the City Council's • <br /> reference.
