no way liable, for any amount other than the payment of the amounts herein set forth <br /> 0or any amounts negotiated under Article 4. <br /> •6.2 It is further agreed that the Fire Department shall carry Public Liability j <br /> Insurance and Workers' Compensation Insurance for its fire prevention services <br /> personnel and on any of its equipment and the operators of such equipment, said <br /> insurance to provide a minimum of$500,000 primary and$1,000,000 excess coverage. <br /> All insurance policies purchased by the Fire Department shall include the City as an <br /> additional insured and shall contain a cancellation clause requiring thirty (30) days' <br /> written notice to be mailed to the City prior to such date of cancellation. A <br /> certificate of insurance shall be provided to the City indicating the. types and <br /> amounts of insurance in. force. <br /> ARTICLE 7 , <br /> ENFORCEMENT ' <br /> 7.1 If any claim, proceeding or action is brought by the City or the Fire <br /> ,Department to enforce theprovisions of this Agreement,Ag • <br /> 3ree , the prevailing party shall <br /> be entitled, in addition to costs of suit, to reasonable attorneys' fees incurred in <br /> connection with any such claim, proceeding or action and the same may be awarded <br /> by the court having jurisdiction of such claim, proceeding or action. <br /> ARTICLE 8 <br /> BENEFIT <br /> 8.1 This Agreement shall be binding upon and inure to the benefit of the <br /> successors of the City and the Fire Department. <br /> ARTICLE 9 <br /> NOTICES <br /> 9.1 Any notice required or permitted to be given under this Agreement shall <br /> be given in writing, and shall be sent by mail to the registered address of the Fire <br /> epartment or the Administrative Office of the City. i <br /> ay <br /> RCL1O3344 <br /> MO-s2 4 <br /> S°d N3Ada9 8 1,Q3NN371 8P:91 96, OE 1WL4 <br />
