<br />Item No: 7I <br />Meeting Date: August 24, 2012 <br />Type of Business: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Resolution 8444 Approving the Renewal of a Legal Services <br />Agreement with Kennedy & Graven, Chartered. <br />Introduction: <br /> <br />At the August 3, 2015 Work Session, the City Council discussed the pending expiration of <br />the legal services agreement with Kennedy and Graven. The consensus of the Council <br />was to proceed with an extension of the agreement. <br /> <br /> <br />Discussion: <br /> <br />Staff analyzed Kennedy & Graven invoices for the previous 30 months and observed that <br />retainer work conducted by the firm was trending below the monthly charges of $2,200. <br />This was brought to the attention of the City Attorney who agreed that the monthly retainer <br />paid by the City could be reduced from $2,200 per month to $2,000 per month without <br />changing the scope and type of work covered under the agreement. The only other <br />revision proposed was to extend the amount of time required that the firm give the City in <br />the event it intended to terminate the Agreement, from 30 days to 90 days. <br /> <br />The term of the new agreement is proposed for three years, the same term as the previous <br />agreements, although the City can terminate the Agreement for any reason at any time. <br /> <br /> <br />Recommendation: <br /> <br />Staff recommends approval of Resolution 8444, a resolution approving the renewal of a <br />legal services agreement with Kennedy & Graven through August of 2018. <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />City Administrator <br /> <br />
