Item No: 7G <br />Meeting Date: November 23, 2015 <br />Type of Business: Council Business <br />Administrator Review: ____ <br /> <br />City of Mounds View Staff Report To: Honorable Mayor and City Council <br />From: Brian Erickson, Public Works Director <br />Item Title/Subject: Resolution 8482, Consider Stormwater Infiltration Program Appeals for <br />Area I of the Street and Utility Improvement Program <br /> <br />Background: <br />Area I of the Street and Utility Improvement Program (Program) is in the design phase and scheduled <br />to begin construction in Spring 2016. The Stormwater Infiltration Program (SIP) is the City’s approach <br />to meeting the stormwater management rules and regulations when reconstructing streets associated <br />with the Program. The SIP is comprised of constructing stormwater infiltration basins, or swales, in the <br />boulevard portion of the City-owned Right-of-W ay (ROW). The City established a process for property <br />owners to appeal the location of an adjacent infiltration basin proposed in this boulevard area in front of <br />their property. A specific set of eleven physical and four hardship parameters must by met for the City <br />to consider the appeal. <br /> <br />The City has provided adjacent property owners in Area I the following opportunities to become aware <br />of the City’s intent to construct the infiltration basins in front of their property and to learn more about <br />the proposed basins: <br />Oct. 1, 2015: Notice sent to adjacent property owners (with SIP FAQ handout – see attached) <br />Oct. 19, 2015: Public information meeting for stormwater infiltration basins <br />Oct. 8 - Nov. 5, 2015: Appeal period and opportunity to ask questions of City staff <br />Nov. 5 - 16, 2015: Engineering staff reviews submitted appeals & develops recommendation <br />Nov. 16, 2015: Streets & Utilities Committee considers appeals & provides recommendation <br />Nov. 23, 2015: City Council considers SIP appeals <br /> <br />The preliminary design identified 85 properties as candidates for infiltration basins in Area I. The City <br />received four SIP appeal forms by the deadline. One appeal was dropped since it is no longer a <br />candidate due to design progression, leaving three appeals to consider. A copy of the appeal forms <br />and the infiltration basin location maps are attached to this report. <br /> <br />Discussion: <br />The following discussion summarizes the appeal for the City Council to consider for approval or denial. <br />Associated property owners attended the Street and Utility Committee meeting on November 16, 2015 <br />and their comments were heard by the Committee. Recommendations from Engineering staff and the <br />Streets and Utilities Committee are at the end of each summary. <br /> <br />2090 Oakwood Drive (Brentley Zaier) – SIP #33 <br />The property owner is appealing for the following reasons: <br />B2. Maintenance <br />Property owner alleges that the <br />proposed basin will result in <br />additional maintenance. The <br />owner also provided <br />documentation of an ongoing <br />disability; however, it is unclear <br />if the disability precludes the <br />owner from maintaining the <br />lawn and boulevard. <br />
