MoU[�ms VIEW <br />of Mounds View Staff <br />Item No: 07D <br />Meeting Date: April 14, 2014 <br />Type of Business: CB <br />City Administrator Review: <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant City Administrator <br />Item Title/Subject: Resolution 8245, Approving a Transfer of Ownership for a <br />Cigarette/Tobacco License Located at Sam's Market, 2408 <br />County Road I <br />Discussion: <br />The present owner of Sam's Market, Ahmad Gazi Mugbil, is requesting a transfer of <br />ownership for their Cigarette/Tobacco License to Khudier Abbas Jrau. All application <br />materials and fees have been submitted to the City. <br />This license was originally scheduled for approval at the March 10, 2014, City Council <br />Meeting. However, the City Attorney expressed concerns about this license, and asked <br />Staff to pull it from the March 10, 2014, City Council Agenda. This was to allow Staff <br />and the City Attorney time to investigate. Staff has been in contact with Mr. Jrau, and it <br />appears there are inconsistencies in the Cigarette/Tobacco application Mr. Jrau <br />submitted. This is based on the City Attorney and Staffs background investigations. At <br />the March 24, 2014, City Council Meeting, Mr. Jrau answered questions from the City <br />Attorney and the City Council. Staff received direction from the City Council to work <br />with Mr. Jrau to resolve the application inconsistencies. <br />On Thursday, April 10, 2014, City Administrator Jim Ericson, Assistant City <br />Administrator Des Crane, Councilmember Gary Meehlhause, City Attorney Scott Riggs, <br />Khudier Abbas Jrau, Mr. Jrau's Interpreter, and Mr. Jrau's attorney (Andrew Larsen - <br />Wille) discussed the concerns on the inconsistencies in the tobacco business license <br />application. We came to the consensus to go forward with approval of the <br />Cigarette/Tobacco License contingent on the following conditions: <br />1. Post signs in visible locations that prohibit loitering inside or near the front <br />entrance. <br />2. Fully light interior of business during business hours. <br />3. Front windows must be clear, untinted, and unobstructed. <br />4. The sales counter, store entrance, and interior of the business shall be <br />videotaped at a quality level that allows the visual identification of patrons <br />and employees. <br />5. Post sign at front entrance that prohibits minors from entering the business. <br />6. Fully cooperate with representatives from the City of Mounds View when <br />present at the business for City business purposes. <br />7. Maintain clean and clear front and rear entrances. <br />
