RESOLUTION 8245 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />Authorizing a Transfer of Ownership for a Cigarette/Tobacco License <br />for Sam's Market, Located at 2408 County Road I <br />WHEREAS, Ahmad Gazi Mugbil and Khudier Abbas Jrau (the "Applicant") recently <br />submitted an application for a cigarette/tobacco license ownership transfer for Sam's Market <br />located at 2408 County Road I; and <br />WHEREAS, Mr. Khudier Abbas Jrau has submitted applicable application materials and <br />fees; and <br />WHEREAS, City staff has had various discussions with the Applicant regarding the <br />requested tobacco license and accompanying application materials; and <br />WHEREAS, the Applicant appeared before the City Council on March 24, 2014, <br />pursuant to the Applicant's requested tobacco license, wherein testimony and responses to <br />questions were received from the Applicant; and <br />WHEREAS, the Applicant initially provided inconsistent and incorrect answers to <br />questions associated with the Applicant's application materials to the City Council; and <br />WHEREAS, the City Council continued the Applicant's tobacco license request to <br />April 14, 2014 to allow City staff to clarify the Applicant's application and associated responses <br />and to formulate a recommendation to the City Council as to the requested tobacco license; and <br />WHEREAS, the licensing period would be April 15, 2014 through June 30, 2014; and <br />WHEREAS, Khudeir Abbas Jrau, consistent with discussions with City staff, agrees to <br />only make retail sales of cigarette and other tobacco products that are approved by federal, state <br />and local laws, including, but not limited to the Minnesota Department of Revenue; and <br />WHEREAS, Khudeir Abbas Jrau, consistent with discussions with City staff, agrees to <br />abide by various business operating conditions to protect the public's health, safety, and welfare <br />as such conditions have proven successful in combating illegal activities frequently found in and <br />around tobacco businesses in other communities; and <br />WHEREAS, all City of Mounds View business licenses must be approved by the City <br />Council. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />MOUNDS VIEW, AS FOLLOWS: <br />1.
