t <br />WHEREAS, Edgewood Middle School, 5100 Edgewood Drive, has requested a <br />wetland alteration permit to allow for the construction of an elevated deck in a wetland area <br />to be used as an outdoor classroom; and, <br />WHEREAS, the property is legally described as: <br />Subject to Roads and Easements, and Except the East 640 feet of the South <br />190 feet of the SE Y4 of the SW'4 of Section 8, Township 30, Range 23, <br />Ramsey County, Minnesota <br />PIN: 08-30-23-34-0003 <br />WHEREAS, the Edgewood Middle School property is located within a wetland <br />zoning district and is subject to the provisions and regulations articulated in Chapter 1010 <br />of the Mounds View Municipal Code; and, <br />WHEREAS, any construction activity is defined as "development' under Section <br />1010.05 of the Code and development within such districts is allowed by permit only; and, <br />WHEREAS, the City Council has found that wetlands within the City, as part of the <br />ecosystem, are critical to the present and future health, safety and general welfare of the <br />land, animals and people within the City, as well as within the Rice Creek Watershed <br />District; and, <br />WHEREAS, the City Council has in mind its statutory obligation to comply with <br />Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek <br />Watershed District, Regulations of the Department of Natural Resources, including <br />provisions for protected waters, Public Law 92.500 (Federal Water Pollution Control Act), <br />open space policies of the Metropolitan Council and its guidelines encouraging protection <br />and enhancement of marshes, wetlands in the flood plain area and the public interest in <br />preventing irreparable destruction or deterioration of valuable natural resources; and, <br />
