ARTICLE TWO <br /> CONSTRUCTION OF IMPROVEMENTS <br /> <br />2.01. Agreement to Construct Improvements. The Developer agrees to the construction of the <br />Improvements required by City Ordinance for development of the Property. The Improvements are <br />more fully described in this Article and on the construction plans, preliminary plat, and specifications <br />approved by the City (the “Plans”). The Developer or its agent must file a final copy of the Plans <br />with the City before starting the construction of the Improvements. All labor, materials, and work <br />performed by the Developer or its contractor for construction of the Improvements will be performed <br />and completed to industry standards and in strict conformance with the Plans. Any deviation from <br />the Plans must be approved in writing by the City. Construction for the Improvements shall be <br />under and subject to the inspection and approval of the City and, where appropriate, any other <br />governmental agency having jurisdiction. <br /> <br />2.02 Designation of Improvements. Improvements to be constructed by the Developer or its agents <br />at Developer’s expense as generally described below and detailed on the Plans are hereinafter <br />referred to as “Improvements”. <br /> <br />A. Public Improvements: The following Improvements to be constructed by the <br />Developer or its agents at Developer’s expense will be owned and maintained by the City after <br />development is completed and work is accepted. <br /> <br />1. Stormwater conveyance, ponding, and treatment systems involving demolition, <br />modification, and addition of storm sewer piping and drainage structures; excavation and <br />embankment of stormwater pond and turf access road; and modifications to existing <br />infiltration basins in boulevard of Longview Drive. <br /> <br />2. Concrete curb and gutter on Longview Drive involving removal and replacement <br />with similar curb and gutter design with appropriate curb cuts to serve planned future single- <br />family dwellings in the development. Patch street to Public Works Standards. <br /> <br />3. Outlot A as shown on the Plans involving removal of dead or dying trees, shrubs, <br />and other unsightly vegetation. <br /> <br />B. Private Improvements: The following Improvements to be constructed by the <br />Developer or its agents at Developer’s expense will be owned and maintained by private property <br />owners after development is completed and work is accepted. <br /> <br />1. Site preparation for construction of ten “pad-ready” single-family dwellings <br />involving grading, drainage, earthwork and soils correction, and turf establishment. Upon <br />completion of site preparation activities, dwelling sites will not require any further soils <br />correction to meet intended foundation bearing capacities for construction of dwellings. <br /> <br />2. Boulder retaining wall behind dwelling pads to delineate wetland limits. <br />Retaining wall is proposed to be approximately two feet in height and continuous through <br />lots. <br /> <br /> <br /> <br />6 <br />
