Item No: 7B <br />Meeting Date: November 24, 2014 <br />Type of Business: Council Business <br />Administrator Review: ____ <br /> <br />City of Mounds View Staff Report <br /> <br /> <br /> <br />To: Honorable Mayor and City Council <br />From: Nick DeBar, Public Works Director <br />Item Title/Subject: Resolution 8327, Considering Stormwater Infiltration Program <br />(SIP) Appeals in Area H of the Street and Utility Improvement <br />Program <br /> <br />Background: <br />Area H of the Street and Utility Improvement Program (Program) is in final design and <br />scheduled to begin construction in spring 2015. The Stormwater Infiltration Program (SIP) is <br />the City’s approach to meeting the stormwater management rules and regulations when <br />reconstructing streets associated the Program. The SIP is comprised of constructing <br />stormwater infiltration basins, or swales, in the boulevard portion of the City-owned Right-of- <br />way. The City established a process for property owners to appeal the location of an adjacent <br />infiltration basin proposed in this boulevard area in front of their property. A specific set of <br />eleven physical and four hardship parameters must by met for the City to consider the appeal <br />(see attached “basis of appeals”). <br /> <br />The City has provided adjacent property owners in Area H the following opportunities to <br />become aware of the City’s intent to construct the infiltration basins in front of their property <br />and to learn more about the proposed basins: <br /> <br />Oct. 8, 2014: Notice sent to adjacent property owners (with SIP FAQ handout – see attached) <br />Oct. 20, 2014: Public information meeting for stormwater infiltration basins <br />Oct. 8 - Nov. 6, 2014: Appeal period and opportunity to ask questions of City staff <br />Nov. 6 - 17, 2014: Engineering staff reviews submitted appeals & develops recommendation <br />Nov. 17, 2014: Streets & Utilities Committee considers appeals & provides recommendation <br />Nov. 24, 2014: City Council considers SIP appeals <br /> <br />The preliminary design identified 66 properties as candidates for infiltration basins in Area H. <br />This number is reduced as final design progresses. The City received two SIP appeal forms <br />by the deadline. One appeal was dropped since they it is no longer a candidate due to design <br />progression, leaving one appeal to consider. A copy of the appeal form and infiltration basin <br />location maps are attached to this report. <br /> <br />Discussion: <br />The following pages summarize the appeal for the City Council to consider for approval or <br />denial. Associated property owners have been informed that they have an opportunity to <br />speak on this matter during the City Council’s consideration. Recommendations from <br />Engineering staff and Streets & Utilities Committee are at the end of each summary.
