Res. 8327, Considering Stormwater Infiltration Program Appeals in Area H <br />Page 2 <br />8321 Knollwood Drive (Don and Debbie Neeck) – SIP #45 <br />The property owners are appealing for the following reasons: <br />A8. Significant Trees <br /> Property owners indicate <br />two spruce trees were <br />removed in anticipation of <br />the street project and want <br />to replant the trees at the <br />completion of the street <br />project. This parameter is <br />related to existing standing <br />trees which do not currently <br />exist. Property owners can <br />still plant trees after street <br />construction. <br />A8. Steep Slopes <br /> Property owners indicate <br />that this is 44-inches of <br />elevation change from the <br />front house sidewalk to street. Existing grades and slopes of boulevard are not <br />excessive for construction of an infiltration basin. <br />B1. Safety <br /> Property owners allege that mowing the basin would be unsafe due to slope, as well as <br />grandchildren playing in front yard would be unsafe environment. The basin slopes will <br />be 1:5 (vertical:horizontal) compared to 1:3 typical maximum slopes for mowers. In <br />addition, the depth will only be one foot below top of curb (6 inches below curb cut). In <br />addition, the basin is located in the city boulevard near the street where young children <br />are more subject to serious injury by passing vehicles. <br />B2. Maintenance <br /> Property owners allege that proposed basin will add unwanted maintenance. This <br />argument does not address the parameter’s requirement related to physical conditions. <br />In addition, maintenance will be similar to maintaining the current turf yard. <br />B4. Other Hardship <br /> Property owners allege that constructing a basin will lower the adjacent property value. <br />This argument is not substantiated with any documentation such as an appraisal. In <br />addition, the City does not need to compensate adjacent property owners for any loss of <br />property value when performing improvements or construction on its public Right-of-way. <br />→ Engineering staff and S/U Committee both recommend denying this appeal. <br /> <br />Recommendation: <br />Engineering staff and the Streets & Utilities Committee conclude that the above appeal does <br />meet any of the physical or hardship parameters which the appeal must be based upon; <br />therefore, it is recommended that the City Council adopt the attached resolution that will deny <br />the SIP appeal received in Area H of the Street and Utility Improvement Program. <br /> <br />Respectfully submitted, <br /> <br /> <br />Nick DeBar - Public Works Director <br />Trees have been <br />removed since <br />photo was taken.
