RM—MM-9 <br />Policy for the Sale of Sara plus City Property <br />I. PURPOSE <br />To establish and set forth the options for the sale or disposal of City -owned surplus <br />property and to define requirements to be followed when utilizing a particular option for <br />disposal of such property. <br />Ii. APPLICABILITY <br />This policy applies to all City employees who are involved in either the disposition or the <br />purchase of surplus City property. <br />III. DEFINITIONS <br />Public Auction – A sale which is open to the public and at which the property is sold to <br />the highest bidder. <br />Public Sale – A sale, other than a public auction, in which property is offered for sale to <br />the public and sold through either sealed bids, direct negotiation, quotations, consigranent <br />or open market. The City retains the right to refuse any and all offers at its sole <br />discretion. <br />Open Market – A freely competitive, widely accessible market in which the City sells its <br />property to the buyer at a price determined by competition. The sale is not restricted to <br />price or bidder; it is determined by the best price offered and accepted by the City. <br />IV. OPTIONS FOR DISPOSAL OF SURPLUS PROPERTY <br />1. Public auction (preferred default option) <br />2. Public sale <br />3. Sale through consignment by a nonprofit organization or other <br />govermnental unit <br />4. Refuse/recycled (damaged property or property which has nominal or no <br />value) <br />5. Donation as authorized by City Council in situations where the cost of <br />disposal exceeds the property value <br />In all cases, except a public auction, the department head for the department in which the <br />property is or has been utilized, must: 1) determine and approve the method of disposal; <br />2) complete and sign a disposition form authorizing the property's disposal; and 3) <br />provide the disposition form to the City ClerklAdministrative Services Coordinator for <br />final approval. <br />
