<br />Item No: 7F <br />Meeting Date: September 24, 2012 <br />Type of Business: CB <br />Administrator Review : ____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br /> <br />From: Jeremiah Anderson, Housing/Code Enforcement Inspector <br /> <br />Item Title/Subject: Hazardous Building Abatement 8379 Red Oak Dr <br /> <br />Date of Report: September 20, 2012 <br /> <br /> <br />Introduction: <br /> <br />Staff seeks City Council approval of a resolution authorizing abatement of a Hazardous <br />Building located at 8379 Red Oak Drive. <br /> <br />Background: <br /> <br />On May 14, 2010 city staff issued an order to vacate regarding the single family dwelling <br />located at 8379 Red Oak Drive owned by Ann Moe who lives at 8373 Red Oak Drive. This <br />order to vacate was based on the fact that the house at 8379 Red Oak Drive did not have <br />water service, sewer service, and electricity provided and had fallen into disrepair. Further <br />investigation revealed that the water and sewer service lines into the home had been <br />disconnected by the City of Mounds View at the request of the property owner Ann Moe <br />several years ago due to the plumbing system in the home falling into disrepair. <br /> <br />In the time since the order to vacate was issued in 2010 there have been numerous contacts at <br />8379 Red Oak Drive resulting in 5 code enforcement cases being opened. <br /> <br />Discussion: <br />Minnesota Statute § 463.16 authorizes the governing body of any City or Town to order <br />the owner of any hazardous building or property within the municipality to correct or <br />remove the hazardous condition of the building or property, or raze or remove the <br />building. Additionally, Minnesota Statute § 463.161 authorizes the governing body of any <br />City or Town to correct or remove the hazardous condition of any hazardous building or <br />property. <br /> <br />Additionally, Minnesota Statute § 463.15 Subd. 3 defines a hazardous building or <br />hazardous property as any building or property which because of inadequate <br />maintenance, dilapidation, physical damage, unsanitary condition, or abandonment, <br />constitutes a fire hazard or hazard to public safety or health. The single family dwelling <br />located at 8379 Red Oak Drive meets these definitions and as such, is considered a <br />hazardous building. <br />
