Staff Report <br />Hazardous Building Abatement <br />8379 Red Oak Dr <br />Page 2 of 2 <br /> <br />Furthermore, Section 106.5 of the City Housing Code provides the City the authority to <br />abate, remove or otherwise remedy the violation and take any action permissible under <br />State law to specially assess or otherwise charge the cost of such abatement, removal, <br />or remedy against the premises where the violation was located. <br /> <br />Lastly, Section 106.3 of the City’s Housing Maintenance Code allows the City to enforce <br />the provisions in the Housing Code by an appropriate form of civil action. This section <br />authorizes the City to require the abatement of everything existing in violation and prohibit <br />occupancy of the premises until such actions have been completed. <br /> <br />Resolution 7991 satisfies the appropriate provisions of the City Housing Code and <br />Minnesota Statutes. <br /> <br /> <br />Recommendations: <br /> <br />Staff recommends approval of Resolution 7991 authorizing a hazardous building abatement <br />order for 8379 Red Oak Drive <br /> <br /> <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> Jeremiah Anderson <br />Housing/Code Enforcement Inspector <br /> <br />Attachments <br /> <br />1.
