Item No: 7K <br />Meeting Date: May 23, 2011 <br />Type of Business: Action <br />City Administrator Review: ________ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Resolution 7794, Approving a Variance Extension for the <br />“Longview Estates” Development; <br /> <br />Introduction: <br />On August 9, 2010, the City Council passed Resolution 7658 that approved a variance to <br />allow for reduced lot widths in a wetland district. The Planning Commission originally <br />denied the variance, but the City Council approved the applicant’s appeal. Per city code, <br />an applicant has one year after the variance or appeal is granted to complete the work or <br />the approval is void unless an extension has been granted. <br /> <br />Chapter 1125.02: Variances and App eals <br />Subd. 5. Lapse of Variance or Appeal: Whenever, within one year after granting a <br />variance or appeal, the work as permitted by the variance or appeal shall not have been <br />completed, then such variance or appeal shall become null and void unless a petition for <br />extension of time in which to complete the work has been granted by the Board of <br />Adjustment and Appeals, such extension shall be requested, in writing, and filed with the <br />City Administrator at least thirty (30) days before the expiration of the original variance or <br />appeal. There shall be no charge for the filing of such petition. The request for extension <br />shall state facts, showing a good faith attempt to complete the work permitted in the <br />variance or appeal. <br /> <br />Discussion: <br />Eichi, Inc., represented by Paul Harstad, has submitted a letter requesting a one-year <br />extension of the variance, as allowed per City Code. The housing market continues to be <br />very slow for home builders, and Mr. Harstad would like to wait another year to complete <br />the major subdivision of the Longview Estates property. <br /> <br />Recommendations: <br />Staff requests that the City Council pass Resolution 7794, approving a one-year extension <br />for the variance that approves reduced lot widths in a wetland district on the Longview <br />Estates property. <br /> <br />Respectfully submitted, <br /> Heidi Heller <br />Planning Associate <br /> <br />Attachments: <br />1.
