Mounds View City Council November 14, 2011 <br />Regular Meeting Page 3 <br /> <br /> 1 <br />Mayor Flaherty opened the public hearing at 7:15 p.m. 2 <br /> 3 <br />Hearing no public input, Mayor Flaherty closed the public hearing at 7:15 p.m. 4 <br /> 5 <br />Council Member Gunn questioned Item 3 on Page 6, and asked if a convenience store would 6 <br />qualify for sampling. City Administrator Ericson stated Walgreens, SuperAmerica or Holiday, 7 <br />which also have a food license, would not be allowed to sample tobacco onsite. 8 <br /> 9 <br />Council Member Hull asked if Vino & Stogies could sell their business to another tobacco seller. 10 <br />City Administrator Ericson indicated this would be possible and the same terms within the City’s 11 <br />Ordinance would apply. 12 <br /> 13 <br />Council Member Mueller expressed confusion with how the sampling of tobacco was allowed as 14 <br />it read in the Ordinance. City Administrator Ericson reviewed the language further stating 15 <br />sampling was prohibited at all tobacco establishments, except if they meet the four stated 16 <br />conditions. He explained this language was separate within the Code in case the State was to 17 <br />change the regulations, the City could easily change this one section. 18 <br /> 19 <br />Mayor Flaherty commented how the proximity regulations would affect current businesses. City 20 <br />Administrator Ericson stated the proximity language would only affect new tobacco licenses and 21 <br />all current tobacco sales would continue in their current establishments. 22 <br /> 23 <br />Mayor Flaherty asked if the hours of sales should be further reviewed. He requested the sales be 24 <br />allowed from 9:00 a.m. to 10:00 p.m. 25 <br /> 26 <br />Fayez Gieth, Tobacco View, explained he understood the City’s new regulations and thanked the 27 <br />Council for thoroughly reviewing the information. 28 <br /> 29 <br />Council Member Mueller summarized the regulations within the Ordinance, noting tobacco 30 <br />would not be sold to minors under the age of 18 and reviewed the hours of operation. 31 <br /> 32 <br />MOTION/SECOND: Stigney/Gunn. To Waive the First Reading and Introduce Ordinance 865, 33 <br />an Ordinance Regulating the Possession, Sale and Consumption of Tobacco and Tobacco 34 <br />Related Devices and Products within the City of Mounds View. 35 <br /> 36 <br /> Ayes – 5 Nays – 0 Motion carried. 37 <br /> 38 <br /> C. 7:15 p.m. Public Hearing, First Reading on Ordinance 866, an Ordinance 39 <br />Amending Title 900 by Deleting Chapter 901 of the City Code Pertaining to 40 <br />the Snow and Ice Control Policy. 41 <br /> 42 <br />Public Works Director DeBar stated the Council adopted Ordinance 451 in 1998 and Chapter 43 <br />901 regulated Snow and Ice Control. Since that time, Mounds View began snow plowing 44 <br />operations throughout the City in house. Staff recommends removing the policy from City Code. 45
