The 2935 Iitghway 10 property is currently zoned R-3 Medium <br /> Density Residential, which allows foster care as a permitted use. <br /> The Mounds View Municipal Code currently states: <br /> "Boarding <br /> III <br /> (house) home; foster children:Restricted to a family dwelling in which children out of their - , . <br /> own homes, ages sixteen(16) years or under, or in the case of mental retardation, age twenty one (21) <br /> or under, are cared for twenty four(24) hours a day for a period of thirty (30) days. The number to be <br /> cared for in one foster child boarding(house) home shall not exceed twelve (12), including the foster <br /> family's own children." <br /> Chapter 462 of the Minnesota Statute allows for a state licensed residential facility, such as a group foster care <br /> home, serving six or fewer persons as a permitted singie family use. Thus, the State says to cities, if a person <br /> is providing foster care to six or fewer persons in a residential disuict, a city cannot place restriction on the <br /> age nor time period the individuals can stay at the premises. However, a city may place additional restric ons <br /> on a foster care facility which has more than six individuals. <br /> The Waldoch's have found the Mounds View Code restricting the ages of the children they can provide foster <br /> care for and how Iong they can provide foster care to each child difficult to work with during"over lap79 <br /> periods.
