Item Description: Discussion relating to a proposed ordinance amendment for amending Chapter 1006, Entitled "R-1 Single Family DistricC (Foster Care). Administrator's Review/Recommendation: -No Comments to supplement this report a(.,.) -Comments attached • ExpIanation/Sumrnary(attach supplement sheets as necessary) S ummary: Former City Clerk-Administrator Harrington was working with Duane and Donna Waldoch of 2935 ghway 10, regarding the City's foster care ordinance. The 2935 Iitghway 10 property is currently zoned R-3 Medium Density Residential, which allows foster care as a permitted use. The Mounds View Municipal Code currently states: "Boarding III (house) home; foster children:Restricted to a family dwelling in which children out of their - , . own homes, ages sixteen(16) years or under, or in the case of mental retardation, age twenty one (21) or under, are cared for twenty four(24) hours a day for a period of thirty (30) days. The number to be cared for in one foster child boarding(house) home shall not exceed twelve (12), including the foster family's own children." Chapter 462 of the Minnesota Statute allows for a state licensed residential facility, such as a group foster care home, serving six or fewer persons as a permitted singie family use. Thus, the State says to cities, if a person is providing foster care to six or fewer persons in a residential disuict, a city cannot place restriction on the age nor time period the individuals can stay at the premises. However, a city may place additional restric ons on a foster care facility which has more than six individuals. The Waldoch's have found the Mounds View Code restricting the ages of the children they can provide foster care for and how Iong they can provide foster care to each child difficult to work with during"over lap79 periods. This overlap period occurs when.the Waidoch's are about to have some children in the process of leaving and are tying to schedule new children to enter their home for foster care.
