Staff is proposing that these uses be added <br /> as conditional uses in the business and industrial districts. <br /> Background/Discussion: <br /> The Children's Home Society has approached the City asking whether they could lease space in <br /> • the Bel Rae. The Children's Home Society would provide day care for approximately 100 <br /> children. The property where the Bel Rae is located is zoned B-3. A review of the Zoning Code <br /> revealed that day care is not listed as a permitted or conditional use in any of the business or <br /> industrial districts in Mounds View. Whether or not the Children's Home Society proposal goes <br /> forward, staff feels this is an opportune time to consider adding day care and group nurseries to <br /> the business and industrial districts as a conditional use. <br /> According to the Mounds View Zoning Code, day care and group nurseries are defined as"a <br /> service provided to the public in which children of school or preschool age are cared for during <br /> established business hours." Home day care is defined as"a family dwelling in which foster care, <br /> supervision and training of children of school or preschool age is provided for during established <br /> business hours. The Zoning Code does not use numbers of children in defining these two uses. <br /> According to Minnesota State Statutes, however, care of 12 children or less is to be regarded as a <br /> permitted single family residential use. Care of 13 to 16 children is to be regarded as a permitted <br /> multifamily residential use, for which a conditional use permit may be required by the local zoning <br /> authority. <br /> Staff is proposing an ordinance amendment to do the following: <br /> • Revise the definitions of home day care and day care and group nurseries need to use the <br /> numerical limits stated in Minnesota Law <br /> • <br />
