The lessor should have the right to examine and inspect the records and books of the operator. <br /> All green fees and golf shop sales should be recorded daily with the date of sale and amount <br /> IDof each transaction. An annual financial statement should be provided. <br /> INSURANCE <br /> The lessee should be required to maintain an approved policy of insurance covering com- <br /> prehensive public liability,fire,and property damage,insuring both the lessee and lessor for the <br /> amount equal to the replacement value of the entire leased premises. <br /> DEFAULT - <br /> If either party fails to comply with any stipulation of an agreement,then the other party has the <br /> option of terminating the lease. <br /> SPECIAL RECOMMENDATIONS <br /> In the process of reviewing present and past lease agreements and interviewing representatives <br /> of public agencies that are involved with a golf course contract,the National Golf Foundation <br /> recommends certain conditions be included in a facility lease that may or may not have been <br /> considered. <br /> 0 <br /> GREEN FEES <br /> Any municipality should recognize, even though its lessee will operate the golf facility as an <br /> independent contractor and with the hope of making aprofit,that,as stated earlier,the purpose <br /> of a municipal golf course is to provide a golfing experience for the greatest number of people <br /> at a reasonable price. The keys here are people and price. Course owners (cities) have to <br /> realize that, even though they will not be operating the golf facility, they still have some <br /> responsibility to the players who use the course. It has been found in many cases in the past, <br /> that when private management assumes operations of a course, the green fees are raised to a <br /> point that may no longer be reasonable. <br /> To combat this potential problem,it is recommended that final approval of green fee rates be <br /> left in the hands of the public agency. At the very least, a monitoring arrangement should be <br /> made under which city officials review any proposed increase. <br /> MAINTENANCE PROGRAM <br /> It is recommended that a program of maintenance be included in any lease agreement.A public <br /> agency that has invested a large amount of money in maintaining its facility at a level that is <br /> satisfactory to its users would want a private contractor to maintain or improve that level. A <br /> stipulated program should include all day-to-day maintenance activities on the golf course <br /> • including, but not limited to: mowing,fertilizing,irrigation,spraying, and equipment care. In <br /> addition, the NGF recommends that a fully qualified golf course superintendent who is a <br /> member of the GCSAA, be employed to administer the maintenance program. - <br /> 5 <br />
