I. RECITALS <br /> served its petition and motion for an order authorizing transfer of • <br /> 1.01. City has <br /> title and possession upon Associates and the above Court has issued its orders approving <br /> the petition and authorizing transfer of title and possession of the easement described in <br /> the petition. <br /> 1.02. Associates hereby admits service of the petition and motion, submits to the <br /> jurisdiction of the court in this proceeding, and agrees to be bound by the above <br /> proceedings. <br /> 1.03. Associates has received and obtained from City a variance from City's sign <br /> code in City Planning Case No. 46296 which City contends has mitigated any adverse <br /> consequences of the taking by City of the Easement herein. <br /> 1.04. Associates represents that it took title to the Subject Property as <br /> Moundsview Square Associates, a Minnesota general partnership consisting of Edward J. <br /> Paster and Jacqueline Paster,pursuant to a quit claim deed dated December 15, 1982 and <br /> filed January 5, 1983 in the office of the County Recorder for Ramsey County, Minnesota <br /> as Document No. 2165602. <br /> 1.05. Associates represents that it filed notice of its election to be known as <br /> Moundsview Square Associates, LLP, a Minnesota limited liability partnership, in the <br /> office of the Secretary of State for the State of Minnesota, in File No. 909-LLP, on <br /> August 4, 1995, pursuant to Filing Receipt No. RI-155375, and filed notice of renewal <br /> of this election in said office on July 16, 1996,pursuant to Filing Receipt No. RI-277896. <br /> 1.06.
