• <br /> ("Easement") and hereby consents to the issuance of an award by the court-appointed <br /> • Commissioners herein awarding damages to it in the amount of$1.00. <br /> IL AGREEMENT. <br /> NOW THEREFORE,IN CONSIDERATION OF THE PREMISES AND OTHER GOOD • <br /> AND VALUABLE CONSIDERATIONS, CITY AND ASSOCIATES HEREBY AGREE AS <br /> FOLLOWS: <br /> • 2.01. Associates hereby: (a) consents to the issuance by the above court of its <br /> order approving petition and its order authorizing transfer of title and possession of the <br /> Easement herein in favor of City; (b)agrees to grant the Easement sought by City in said <br /> proceedings, provided that the Easement granted to City is consistent with Exhibit B <br /> attached hereto ("Easement"); and (c) consents to the issuance by the court appointed <br /> commissioners of an award of damages in the amount of$1.00 to Associates due to the <br /> taking of said Easement. <br /> 2.02. Associates hereby waives any further claim for compensation in this <br /> proceeding. <br /> 2.03. This Agreement is contingent upon the granting of consent hereto by: (a) <br /> the holder of a mortgage encumbering the Subject Property, Great West Life & Annuity <br /> Insurance Company, a Colorado corporation; and (b) the City Council of the City of <br /> iew.
