} <br /> ORDINANCE NO. 596 <br /> CITY OF MOUNDS VIEW • <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> AN ORDINANCE AMENDING SECTION 1106.02, SUBD. 2 AND 3 OF TIE MOUNDS <br /> VIEW ZONING CODE TO ALLOW EIGHT CHILDREN IN FOSTER FAMILY <br /> HOMES, GROUP HOMES AND GROUP FOSTER HOMES; PLANNING CASE NO. SP- <br /> 014-97 <br /> THE CITY OF MOUNDS VIEW ORDAINS: <br /> SECTION 1: Section 1106.02, Subd. 2 and Subd. 3 be amended to read as follows: <br /> Subd. 2. Permitted single family uses allowed under Minnesota Statutes 462.357, Subd. 7 as <br /> follows: <br /> a. A state licensed residential facility serving six or fewer persons, except as <br /> provided in Subd. 3 of this Section 1106.02; <br /> b. A licensed day care facility serving 12 or fewer persons; <br /> c. A group family day care facility licensed under Minnesota Rules, parts <br /> 9502.0315 to 9501.0445 to serve 14 or fewer children. <br /> d. Residential facilities whose primary purpose is to treat juveniles who have <br /> violated criminal statutes relating to sex offenses or have been adjudicated <br /> delinquent on the basis of conduct in violation of criminal statutes relating <br /> to sex offenses shall not be considered a permitted use. <br /> Subd. 3. Notwithstanding the provision of Subdivision 2-2.a. herein, foster family homes as <br /> identified defined in Minnesota Rules Chapter 9545, Section 9545.0010, Subp. 7 <br /> which relate to the Department of Human Services, and <br /> group homes and group foster homes as defined in Department of Corrections <br /> Rules, extracted from Minnesota Rules, Chapter 2925, Section 2925.0100, Subp. <br /> 9 shall be allowed as permitted uses to serve not more than eight children per <br /> home, not including the foster family's own children. <br /> • <br />
